These Terms & Conditions ("Terms") govern your use of tariohvac.com (the "Site") and your engagement of services from Tario HVAC, LLC ("Tario," "we," "us"), a Maryland limited liability company located at 1319 Maple Ave, Halethorpe, MD 21227. Please read Section 15 carefully — it requires individual arbitration of disputes and waives class actions, with a 30-day opt-out.

1. Acceptance of These Terms

By accessing the Site, submitting a form, calling us, or engaging our services, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Site. Written service agreements, proposals, or invoices you sign with Tario govern the specific work they describe; where they conflict with these Terms, the signed document controls for that work.

2. Our Services

Tario provides residential and commercial heating, cooling, plumbing, indoor-air-quality, and related home services across Maryland, Washington, DC, and Northern Virginia, holding the licenses listed in the Site footer (including MD HVACR #90754 and MD PLB & GFC #92636). Service availability, scheduling, and scope are confirmed at booking; "24/7" refers to our answering and emergency-dispatch availability, and emergency response times vary with conditions and demand.

3. Estimates & Pricing

Prices, promotions, plan rates, and any figures on the Site are informational and may change without notice. Estimates are non-binding until confirmed in a written proposal or invoice; on-site diagnosis may reveal conditions that change scope or price, which we will communicate before proceeding. Promotional offers cannot be combined unless stated and are subject to their posted terms.

4. Informational Content; No Professional Advice

Articles, guides, the Learning Center, the glossary, and other Site content are provided for general information about home systems. They are not engineering, legal, financial, or safety advice for your specific situation, and reading them does not create a service relationship. Conditions vary by home — have your systems evaluated by a qualified professional before acting.

5. AI & Automated Content Disclaimer

Portions of the Site's informational content may be drafted or assisted by automated and AI tools and then reviewed by our team. Despite review, such content may contain errors or omissions. It is provided "as is" for general education, and Tario disclaims liability for actions taken in reliance on it. Report suspected inaccuracies to support@tariohvac.com and we will review promptly.

6. Intellectual Property

The Site and its content — text, graphics, logos, photographs, and design — are owned by Tario or its licensors and protected by copyright and trademark law. You may view and print pages for personal, non-commercial use. Any other reproduction, scraping for commercial redistribution, or use of our marks requires our prior written permission. Third-party marks (including Carrier® and Wells Fargo®) belong to their owners and are used to describe genuine affiliations.

7. Acceptable Use

You agree not to:

• submit false, misleading, or fraudulent requests or applications;
• interfere with the Site's operation or security, or probe or bypass its protections;
• use bots or automated means to submit forms or harvest content;
• upload malicious code or unlawful, infringing, or abusive material;
• impersonate any person or misrepresent your affiliation.

8. User Submissions

Information you submit through forms must be accurate and yours to share. For reviews, photos, or feedback you provide to us for publication, you grant Tario a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with our business (with attribution consistent with how you provided it). Job-application materials are used solely for recruiting as described in the Privacy Policy.

9. Third-Party Services & Financing

The Site links to and embeds third-party services (including Google Maps and our social profiles) that operate under their own terms. In particular, consumer financing is offered through Wells Fargo Bank, N.A.: applications are made on Wells Fargo's site, and all credit decisions, account terms, and servicing are made solely by Wells Fargo, with approved credit. Tario is not a lender, does not make credit decisions, and is not responsible for Wells Fargo's actions or terms.

10. Billing, Payment & Financing

Payment terms for services are stated on your proposal or invoice. Amounts are due upon completion unless otherwise agreed in writing. Maintenance-plan rates (e.g., Basic Care $169/year; Commercial $430/year) are confirmed at enrollment and renew per the plan's stated terms. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum permitted by Maryland law, plus reasonable collection costs.

11. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THIS SECTION APPLIES TO THE SITE; WORKMANSHIP AND EQUIPMENT WARRANTIES FOR PERFORMED SERVICES ARE STATED IN YOUR WRITTEN PROPOSAL OR INVOICE AND ARE NOT REDUCED BY THESE TERMS. NOTHING HERE LIMITS WARRANTIES THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) TARIO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM THE SITE OR THESE TERMS; AND (b) TARIO'S TOTAL AGGREGATE LIABILITY ARISING FROM THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $500 OR THE AMOUNT YOU PAID TARIO FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold Tario, its owners, and employees harmless from claims, damages, and reasonable attorneys' fees arising out of your misuse of the Site, your violation of these Terms, or content you submit — except to the extent caused by Tario's own negligence or willful misconduct.

14. Governing Law & Venue

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws rules. Subject to Section 15, any court proceeding will be brought exclusively in the state or federal courts located in Maryland (Baltimore County or the U.S. District Court for the District of Maryland), and you consent to their jurisdiction.

15. Binding Arbitration & Class-Action Waiver

Except for small-claims matters and either party's right to seek injunctive relief for IP misuse, any dispute arising out of the Site or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Baltimore County, Maryland (or remotely by agreement). The arbitrator's decision is final and enforceable in court. YOU AND TARIO EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

30-day opt-out: you may reject this arbitration provision by emailing support@tariohvac.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms; opting out does not affect any other provision.

16. Termination

We may suspend or terminate Site access for violations of these Terms. Sections that by their nature should survive (IP, disclaimers, liability limits, arbitration, governing law) survive termination.

17. Severability; Entire Agreement; Changes

If any provision is found unenforceable, the remainder stays in effect and the provision will be enforced to the maximum extent permitted. These Terms, the Privacy Policy, and any signed service documents are the entire agreement regarding their subject matter. We may update these Terms; the effective date above reflects the current version, and continued use after changes constitutes acceptance.
